현행 ‘스토킹범죄의 처벌 등에 관한 법률(이하 스토킹처벌법)’은 지난해 10월부터 시행된 지 1년여가 지났으나, 법 시행 이후에도 잔혹한 스토킹 범죄를 저지른 가해자들로 인해 피해 사례가 잇따랐으며, 최근 ‘신당역 스토킹 살인사건’을 계기로 피해자 보호 강화를 위한 제도보완의 필요성이 제기돼 왔다.

 

또 현재까지 스토킹처벌법은 있으나 스토킹피해자 보호 및 지원에 관한 법적 근거는 없는 상황이다. 스토킹은 범죄라는 사회적 인식 제고 및 예방 교육 의무화 등을 담은 스토킹 피해자 보호법 제정이 시급하다는 의견들이 지적됐다.

 

이에 국회 여성가족위원회 소속 김선교 국민의힘 의원(여주·양평)은 현안대책 회의 및 당정회의를 통해 논의된 스토킹 피해자 강화 방안을 중심으로 ‘스토킹예방 및 피해자 보호 등에 관한 법률(이하 스토킹보호자법) 제정안’과 ‘스토킹 처벌법 개정안’을 마련했다.

 

우선 ‘스토킹처벌법 개정안’에는 스토킹범죄 피해자에 대한 신변안전조치를 포함하는 피해자보호명령제도를 도입하여 피해자가 수사기관을 거치지 않고도 법원에 직접 신청하여 보호받을 수 있도록 하고, 스토킹행위자에 대한 잠정조치기간을 현행보다 2배 연장하여 스토킹행위자에 대한 접근금지는 4개월까지, 유치장(구치소)에의 유치는 2개월까지 조치할 수 있도록 했다.

 

또 스토킹피해자 보호법안에는 ▲국가 및 지자체의 스토킹 예방·방지와 피해자 보호·지원을 위한 신고체계 구축·운영, 지원 시설의 설치·운영, 법률구조 조치 ▲ 3년주기 스토킹 실태조사 ▲ 국가기관장 등의 스토킹 예방교육 ▲ 스토킹발생시 통보 및 처리결과 재발방지대책 제출 의무 ▲ 스토킹 피해자 불이익 금지조치 ▲ 피해자 및 가족의 취학 지원 ▲ 피해자 지원시설 ▲ 사법경찰관리의 현장 출동 조사 등에 관한 내용을 담았다.
